Terms and conditions of sale

1. Purpose

Fixara is management software for independent repair shops. It provides each shop with a website, a quote request page and an online shop. These terms govern the Customer’s use of those pages. The Platform itself sells no repair and no item.

2. Role of the platform

The platform acts as the shop’s technical provider. It does not perform the repair, sells no item and is not a party to the contract between the Customer and the Repairer. A request sent from a shop’s website is passed on to that shop only.

3. Quote requests and orders

A quote request does not bind the Customer and nothing is owed for it: the price and lead time are confirmed by the Repairer. Items in a shop’s online store are sold by that shop. When online payment is offered, it is collected directly on the Repairer’s account, with no commission for the Platform. A consumer who buys an item at a distance has fourteen days from delivery to withdraw, with the Repairer.

4. Legal guarantee

The Client benefits from the legal guarantee of conformity. The repair itself is further guaranteed by the Repairer; its duration appears on the intake form and then on the invoice.

5. Complaints

Any complaint about the service is addressed first to the Repairer, who performs it. The Platform forwards it and follows it up if the Client raises it, without substituting itself for the Repairer.

6. Mediation and disputes

A consumer Client may use a consumer mediator free of charge, after first submitting a written complaint. The competent mediator’s details appear on the intake form and on the invoice issued by the Repairer.

7. Personal data

Processing of the Client's personal data is described in the privacy policy. A device handed over contains personal data: the Repairer accesses only what is necessary for diagnosis and retains none of it. Privacy policy

8. Applicable law

These terms are governed by the law of the Repairer's country of establishment. Mandatory provisions protecting the consumer in their country of habitual residence remain acquired. Failing an amicable settlement, any dispute falls to the courts having jurisdiction under the law.
